TaxProf Blog: ABA Approves Duncan Law School, Defers Action on InfiLaw’s Acquisition of Charleston

The Council of the Section of Legal Education and Admissions to the Bar of the American Bar Association, at its meeting on December 5-6, 2014, granted provisional ABA approval to Lincoln Memorial University Duncan School of Law.

The ABA’s Council of the Section of Legal Education and Admissions to the Bar on Dec. 6 deferred action on InfiLaw’s request for its acquiescence in the sale. During its two-day meeting in Puerto Rico, the council decided that InfiLaw must first win the blessing of state regulators. “There was no decision reached on the merits,” said Barry Currier, the ABA’s managing director for legal education.

InfiLaw Holding LLC released a written statement Monday warning that delaying the sale puts the law school at risk. “As we have noted since we announced our intention to purchase the Charleston School of Law, InfiLaw is the only organization with a source of capital and capacity to tackle the financial challenges facing the school and is prepared to do so upon approval of the regulatory bodies and completion of the sale,” the statement reads. “No other viable option has been presented which has both the financial capacity and the experience in owning and operating a successful law school.” The financial problems will only mount barring a sale, InfiLaw said.

The South Carolina Commission on Higher Education likely won’t act on the acquisition until February, according to a memo prepared by the ABA’s Accreditation Committee
